Chairman's Note

Dear Members of the European Society of Construction Law (ESCL),

I would like to extend my heartfelt thanks to the General Assembly for electing me to serve as Chairman of the Council. Your support means a great deal to me. I am excited to take on this role and contribute to the continued success of our Society. Over the past decade, our community has offered me countless opportunities for learning and collaboration, and I am grateful for the chance to give back.

In my vest of new Chairman, I am thrilled to bring to your attention some of the exciting events we have lined up, particularly the ESCL Conference 2024, which was held on 18 October in the beautiful city of Antwerp, Belgium.

The conference was exceptionally well-organized, covering a wide range of topics such as the design responsibility, the architect's role, construction standards, regulatory frameworks, early contractor involvement, procurement processes, fit-for-purpose buildings, circular construction, etc. These topics, of great relevance to the European construction sector, were discussed with numerous references to real-world examples, legislation, and areas for improvement. The ESCL Conference 2024 was a resounding success, providing a unique opportunity to network with delegations from member states, practitioners from beyond the EU, and academics seeking new research avenues in the construction field. The success of the ESCL Conference 2024 is due to the hard work of Luc Imbrechts, member of the Council, and his team. Their meticulous attention to detail has made this conference a truly enjoyable and productive event, fostering new ideas and inspiring future endeavors.

ESCL Webinars:

In September and October 2024, we hosted two engaging webinars. On 19 September, Francesco Capotorto of Ankura (London) delivered a comprehensive presentation on 'Recent Developments in Construction Disputes: Unraveling Artificial Intelligence's Impact in Expert Witness Investigations'. On 23 October, Florian Englert of Prof Englert and Partners Rechtsanwälte (Germany) delved into the complex issue of 'Offshore explosive ordnance clearance as a European challenge', highlighting its significant impact on the construction sector, particularly renewable energy projects. Both webinar presentations are now publicly accessible on the ESCL website. We are currently planning our next events for early 2025 and invite you to submit proposals for potential topics and speakers. The Council will carefully evaluate each suggestion, considering the originality of the topic, the speaker's expertise, and their geographic location to ensure a broad European reach.

ESCL Conference, Naples, 26 September 2025 - Save the Date

As anticipated in our previous newsletter of October 2024, the next ESCL Conference will be held on 26 September, 2025, in the wonderful city of Naples (Italy). The conference will be dedicated to analyzing and delving into the complex and fascinating balance between the interests underlying a Construction Project and those related to the cultural context in which it is situated. "Construction Projects and Cultural Context" is the title of a conference that will focus on analyzing the importance of respecting the cultural context, the development of smart cities in ancient cities, the proliferation of renewable energy production plants in proximity to contexts of high artistic impact, the inevitable coexistence of people from different origins and the related construction of works that are inserted in places of different origins, and so on.

Call for abstracts

We invite potential speakers to submit abstracts for panels and sessions, contributing to the diverse and rich discussions at the ESCL Conference of Naples dated 26 September 2025 and dedicated to “Construction Projects and the Cultural Context”.

The deadline is set for January 17th, 2025.

ESCL Workshop, Naples, 27 September 2025

For the first time, participants at the ESCL Conference will have the opportunity to attend an in-depth workshop on 27 September, the day after the conference.

This will be an in-depth analysis session limited to 20 participants. With the support of esteemed speakers, attendees will analyze and discuss new developments in construction law, with a particular, though not exclusive, focus on “ADR and cultural property”.

This is the beginning of a new journey together to promote the study of the construction industry, the exchange of ideas, and the affirmation of new opportunities for personal, cultural, and professional growth.

Review ESCL Conference 2024 in Antwerp

This year's ESCL conference in Antwerp/Belgium was a great success. Top-class presentations, great events and lots of participants. A detailed review of the event will follow.

We would like to take this opportunity to thank Luc Imbrechts, his wife and the entire team. They organized a great conference that we will remember for a very long time.

 

New ESCL Member "ARGE Baurecht"

We are very pleased that the ESCL has grown. At this year's General Assembly, ARGE Baurecht from Germany was admitted to the ESCL. We would like to take this opportunity to briefly introduce our new member:

The Committee for Construction and Real Estate Law (“ARGE Baurecht”) is a professional organization for lawyers specializing in private construction law, working to promote the professional and economic interests of its 2300 members. Under the umbrella of the German Bar Association it advises and guides legislators, helping shape the future of the field. As the publisher of Conciliation and Arbitration Rules for Construction Disputes (“SOBau”) it also contributes to the development of alternative methods of dispute resolution.

A central task of the Committee is the further training of its members. It hosts two conferences a year on current judgments and developments in the field, as well as seminars and workshops, including for paralegals and on communication skills. The Committee and its Young Construction Lawyers Working Group also place great emphasis on promoting young talent through courses for new colleagues and a mentoring programme.

A special thank you to the former members of the ESCL Council

In October 2024, several members of the Council concluded their term, though they remain steadfast pillars of our Society. I believe this is also an opportunity to thank them once again for the important work they have carried out exclusively in the interest of the ESCL.

I would like to express my gratitude to Bastian Fuchs, who, in his role as Chairman during the pandemic and the years immediately following, never failed to provide his wise and steady guidance. He has always been a valuable support for every initiative and has been an authoritative figure representing our Society.

Many thanks to Richard Bailey for being a valuable reference for our Society; for promoting the reform of our Bye-laws, for always having been a solid bridge between our Society and the UK Society of Construction Law and its international chapter. Richard, with his inexhaustible energy, has always been our ambassador abroad, the point of reference for countless associations around the world. I am confident that Richard, even as a member of the ESCL, will continue to provide us with his support and his historical memory of the new ESCL.

I thank Ovidiu Dumitru for promoting the improvement of many of our initiatives, consistently organizing excellent conferences in Bucharest, and always providing relevant input and contributions. His energetic, active, and often critical participation has enabled us to improve and has significantly elevated the Romanian Society of Construction Law, making it a relevant player on the international stage.

New members of the ESCL Council

Three new Council members were elected at this ESCL General Assembly. We are delighted to have their support and wish them every success in their work:

Sercan Kulaksızoğulları (Turkey)

Sercan holds a BSc degree in civil engineering and a master’s degree in law, currently working as a director at HKA, a global construction consultancy, expert witness and financial damages firm.
Sercan is a founding member of the Society of Construction Law Turkiye and is the current Secretary General.
​Having acted in contract and commercial management positions in major superstructure, infrastructure and oil & gas projects, Sercan has experience in contract drafting, negotiation, contract/commercial and change management, claims and dispute resolution.

Stephanie Englert-Dougherty (Germany)

Stephanie is a distinguished attorney admitted to the German and New York bar with a specialization in construction law and international commercial law.
She is a founding partner at the law firm prof englert + partner Rechtsanwälte PartGmbB. Stephanie brings extensive expertise in advising on complex construction projects and cross-border transactions.
In addition to practicing law, she is a university lecturer in construction law, a published author in legal literature and a member of the “International Construction Law” working group of the German SCL.

Victoria Penkova (Bulgaria)

Victoria Penkova is co-founder and Chair of  the Bulgarian Society of Construction Law (BSCL).
She is the managing partner at Penkova & Partners, with over 30 years of experience. She has extensive experience in the fields of construction, real estate, contract and commercial law, M&A and litigation.
Furthermore, Victoria is member of the Bulgarian Association of Consulting Engineers and Architects (BACEA) and is a dispute adjudicator at the FIDIC National List at BACEA.

 

ESCL Conference 2025 in Naples - Call for Abstracts

Next year's conference will take place on 26 September 2025 in Naples (Italy). The topic of the event will be "Construction Projects and the cultural context".

We invite potential speakers to submit abstracts for panels and sessions,
contributing to the diverse and rich discussions at the ESCL Conference.
